General Terms and Conditions of Sale (GTC)

ARTICLE 1 – PURPOSE AND SCOPE

1.1 These General Terms and Conditions of Sale (“GTC”) govern without reservation the sales of products and services made on the website lespetitsarchitectes.com, intended to promote the development of autonomy and different forms of intelligence in children.

1.2 Detailed descriptions of products and services (educational materials, teaching aids, etc.) are available on the Website. Customers are advised to review these descriptions before placing any order. The choice and purchase of a product or service are the sole responsibility of the Customer.


ARTICLE 2 – ORDERS

2.1 The ordering process on the Site comprises several steps: selection of products or services, verification of the order details and total price, correction of any errors, and confirmation of the order after acceptance of the Terms and Conditions. All contractual information is presented in French and will be confirmed at the time of order validation.

2.2 The company reserves the right to cancel or refuse any order in the event of a dispute with the Customer regarding a previous order.


ARTICLE 3 – RATES

3.1 The prices of products and services are indicated in euros, including VAT. These prices are fixed and non-revisable during their period of validity, as displayed on the Website. Prices do not include delivery charges, which are billed separately.


ARTICLE 4 – PAYMENT TERMS

4.1 Payment is made in full, at the time of order, by bank card or any other means indicated on the Site.

4.2 Payment security is ensured by Shopify.

4.3 Shopify Payments complies with the PCI DSS (Payment Card Industry Data Security Standard), which means it meets high security standards for the processing, storage and transmission of credit card information.


ARTICLE 5 – DELIVERY

5.1 Time limits and liability

Products are delivered to the address provided or to the collection point chosen by the Customer within the timeframes specified on the Website. The Company shall not be held liable for any shipping or delivery delays, particularly those attributable to the carrier or events beyond the Company's control (strikes, inclement weather, logistical disruptions, force majeure). Such delays shall not give rise to any compensation, order cancellation, or early refund.

5.2 The Customer is required to check the condition of the products upon delivery. Any anomaly concerning the delivery (missing product compared to the order form, damaged package, broken products, etc.) must be reported.

5.3 Parcel not collected from collection point & options

If the parcel is not collected within the time limit set by the collection point, it will be returned to our logistics center by the carrier. Upon receipt, two options are available:

Option A – Reshipment of the package
The customer receives a payment link to settle the bill.

  • the return shipping costs (equivalent to the initial shipping costs)

  • the reshipping costs (same conditions as the initial shipment, if the address remains unchanged)

  • €0.60 excluding VAT for receiving the package at our warehouse

  • €0.90 excluding VAT for return processing fees

No further shipments will be made until these fees have been paid in full.

These fees correspond to the actual costs charged by our logistics providers and carriers, and are not generated by our company.

Option B – Refund
The customer can request a refund for their order.
The amount refunded will be calculated as follows:
Order amount – (return shipping costs + logistics costs)

  • Return shipping cost = amount of the initial shipment

  • Logistics fees: €0.60 excl. VAT (receipt) + €0.90 excl. VAT (restocking)

The refund will be made within a maximum of 14 days after the refund request, subject to receipt and verification of the package by our warehouse.

These fees correspond to the actual costs charged by our logistics providers and carriers, and are not generated by our company.


ARTICLE 6 – RIGHT OF WITHDRAWAL

6.1 In accordance with current legislation, the Customer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal, without having to justify reasons or pay penalties, with the exception of return costs.

6.2 To exercise this right, the Customer must contact the Company by email at archi@lespetitsarchitectes.com , indicating their order number. Products must be returned to the address provided by the Company, in their original condition, complete, unopened, and unused.

6.3 Return shipping costs are the responsibility of the Customer.

6.4 Logistics fees will be deducted from the refunded amount:

  • €0.60 excluding VAT for receiving the package

  • €0.90 excluding VAT for restocking. 6.5 The right of withdrawal cannot be exercised for products

    6.5 – Exceptions to the right of withdrawal

    The right of withdrawal cannot be exercised for the following products:

    • open,

    • used,

    • or whose packaging has been unsealed, for reasons of hygiene and safety (article L.221-28 of the Consumer Code).

6.5 In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for the following products:

  • Open
  • Used
  • Or whose original packaging has been unsealed, for hygiene and safety reasons.

6.6 If the conditions are met (products unopened, unused, complete, in perfect condition and in their original packaging), the Company will proceed with the refund to the same means of payment.
The refund will be made within a maximum of 14 days after the refund request, subject to receipt and verification of the package.

6.7 No refund will be issued until the package has been received and checked by our logistics warehouse.


ARTICLE 7 – GUARANTEES

7.1 Our tools are designed according to strict standards and undergo rigorous checks before shipment. However, if a product is deemed defective or does not conform to the order, the Customer may request, in accordance with the law, repair, replacement, or, failing that, a refund.

7.2 To facilitate the handling of the issue, we invite the Customer to contact us within 14 days of receiving the product, at the following address:
archi@lespetitsarchitectes.com, specifying:

  • The order number
  • A detailed description of the problem observed
  • Photos of the product in question

7.3 Return costs will only be covered if the product is recognized as defective or non-compliant by our customer service, after analysis of the information provided.


ARTICLE 8 – INTELLECTUAL PROPERTY

8.1 All elements of the products and services sold on the Site, whether visual or audio, including the underlying technology, are protected by copyright, intellectual property rights, or patents. They are the exclusive property of Les Petits Architectes SAS

8.2 Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the products and services sold on the Site, regardless of the means or process used, is prohibited without the prior written authorization of Les Petits Architectes SAS


ARTICLE 9 – PERSONAL DATA

9.1 The Company undertakes to comply with the applicable regulations regarding personal data (GDPR).

9.2 The Client has rights of access, rectification, deletion and portability, which he can exercise by contacting the Company at the address indicated in the legal notices.


ARTICLE 10 – USE OF COOKIES

10.1 The Site uses cookies to improve user experience, analyze audience and personalize content.

10.2 The Customer may refuse cookies, but this may limit certain website functionalities. However, disabling cookies may affect certain website functionalities.


ARTICLE 11 – APPLICABLE LAW AND DISPUTE RESOLUTION

11.1 These General Terms and Conditions are governed by French law.


11.2 In the event of a dispute, an attempt at amicable resolution will be preferred before any legal action.

11.2 In the absence of an amicable agreement, the dispute will be brought before the competent courts in accordance with Article R.631-3 of the Consumer Code.


ARTICLE 12 – FORCE MAJEURE

12.1 Les Petits Architectes SAS cannot be held responsible for any contractual breach in the event of force majeure as defined in Article 1218 of the Civil Code (e.g., strike, fire, natural disaster, pandemic, etc.).


ARTICLE 13 – AMENDMENTS TO THE TERMS AND CONDITIONS OF SALE

13.1 Les Petits Architectes SAS reserves the right to modify these Terms and Conditions at any time. The new Terms and Conditions will apply only to sales made after they are published online on the Website.

13.2 The Customer is invited to regularly consult the Terms and Conditions to be aware of any changes.


ARTICLE 14 – ENTIRE AGREEMENT

14.1 These General Terms and Conditions constitute the entire agreement between Les Petits Architectes SAS and the Client. They supersede any other document or general or specific terms and conditions not expressly accepted by Les Petits Architectes SAS.


ARTICLE 15 – ACCEPTANCE OF THE TERMS AND CONDITIONS

15.1 Any order placed on the Site implies the Client's unreserved acceptance of these Terms and Conditions.
