Terms of Sales
ARTICLE 1 – PURPOSE AND SCOPE OF APPLICATION
1.1 These General Conditions of Sale (“GCS”) unreservedly govern the sales of products and services made on the site lespetitsarchitectes.com , intended to promote the development of autonomy and different forms of intelligence in children.
1.2 The detailed description of the products and services (educational materials, educational tools, etc.) is available on the Site. Before any order, the Customer is invited to read it. The choice and purchase of a product or service are the sole responsibility of the Customer.
ARTICLE 2 – ORDERS
2.1 The ordering procedure on the Site includes various stages: selection of products or services, verification of the order details and its total price, correction of any errors, confirmation of the order after acceptance of the General Terms and Conditions. All contractual information is presented in French and will be confirmed at the time of order validation.
2.2 The company reserves the right to cancel or refuse any order in the event of a dispute with the Customer over a previous order.
ARTICLE 3 – PRICES
3.1 The prices of products and services are indicated in euros, including VAT. These prices are fixed and not subject to revision during their period of validity, as displayed on the Site. Prices do not include delivery costs, which are charged in addition.
ARTICLE 4 – PAYMENT CONDITIONS
4.1 Payment is made in cash, when ordering, by bank card or any other means indicated on the Site.
4.2 Payment security is provided by Shopify.
4.3 Shopify Payments is PCI DSS (Payment Card Industry Data Security Standard) compliant, which means it meets high security standards for processing, storing, and transmitting credit card information.
ARTICLE 5 – DELIVERY
5.1 The products are delivered to the address indicated by the Customer when ordering. Shipping and delivery times are indicated on the Site. In the event of a delay, Les Petits Architectes SAS cannot be held liable, and this cannot give rise to damages or order cancellations.
5.2 The Customer is required to check the condition of the products upon delivery. Any anomaly concerning the delivery (product missing from the order form, damaged package, broken products, etc.) must be notified under the conditions provided on the Site.
5.3 Package not collected from relay point & return conditions:
If you do not collect your package within the time limit set by the relay point, it will be automatically returned to us by the carrier.
Upon receipt of the package by our logistics center, a payment link will be sent to you to pay the costs related to reshipping, namely:
Reshipping costs, the same as the first shipment (if your delivery information has not been changed)
- €0.60 excluding VAT for parcel reception costs, relating to our logistics warehouse
- €0.90 excluding VAT return processing fee, relating to our logistics warehouse
These charges correspond to the actual costs imposed by our logistics provider and are not our fault.
The package can only be reshipped once all of these costs have been paid.
ARTICLE 6 – RIGHT OF WITHDRAWAL
6.1 In accordance with current legislation, the Customer has a period of 14 calendar days from receipt of the products to exercise his right of withdrawal, without having to provide reasons or pay a penalty, with the exception of return and logistics costs.
6.2 To exercise this right, the Client must inform Les Petits Architectes SAS of their decision to withdraw by email to archi@lespetitsarchitectes.com, specifying their order number, and return the products in their original condition, complete (packaging, accessories, instructions), unused and unopened, to the address that will be indicated to them, paying the shipping costs themselves.
6.3 Return costs are the responsibility of the Customer.
6.4 Logistics costs charged by our warehouse will then be deducted from the amount refunded or the credit note issued:
- €0.60 excluding VAT for receipt of the package
- €0.90 excluding VAT for restocking (returning to shelves)
6.5 In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for products:
- Open
- Used
- Or whose original packaging has been unsealed, for hygiene and safety reasons
6.6 If the conditions are met (unopened, unused, complete, in perfect condition and in their original packaging), a credit note may be issued.
The amount of this credit will correspond to the price of the returned items, less the logistics costs mentioned above.
The credit is valid for a period of 12 months from the date of issue.
6.7 No credit note can be issued until the package has been received and checked by our logistics warehouse.
ARTICLE 7 – GUARANTEES
7.1 Our tools are designed to strict standards and are subject to rigorous checks before dispatch. However, if a product is deemed defective or not in accordance with the order, the Customer may request, in accordance with the legislation, repair, replacement, or, failing that, a credit note.
7.2 To facilitate support, we invite the Customer to contact us within 14 days of receipt of the product, at the following address:
archi@lespetitsarchitectes.com, specifying:
- The order number
- A detailed description of the problem observed
- Photos of the product concerned
7.3 Return costs will only be covered if the product is recognized as defective or non-compliant by our customer service, after analysis of the elements provided.
ARTICLE 8 – INTELLECTUAL PROPERTY
8.1 All elements of the products and services sold on the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of Les Petits Architectes SAS
8.2 Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the products and services sold on the Site, whatever the means or process used, is prohibited, except with the prior written authorization of Les Petits Architectes SAS
ARTICLE 9 – PERSONAL DATA
9.1 Les Petits Architectes SAS is committed to protecting the personal data of Customers. All personal data collected in connection with orders is treated with the strictest confidentiality, in accordance with the Personal Data Protection Policy available on the Site and in compliance with the GDPR.
9.2 The Client has the right to access, rectify, delete, and transfer their personal data. To exercise this right, the Client may contact Les Petits Architectes SAS at the email address provided in the Legal Notices.
ARTICLE 10 – USE OF COOKIES
10.1 The Site uses cookies to improve the user experience, analyze the audience and personalize content.
10.2 The Customer may configure his browser to refuse cookies or to be informed of their sending. However, disabling cookies may affect certain features of the Site.
ARTICLE 11 – APPLICABLE LAW IN THE EVENT OF DISPUTES
11.1 French law applies to the General Terms and Conditions and contracts concluded by Les Petits Architectes SAS via the Site. In the event of a dispute, an attempt at amicable resolution will be preferred before any legal action.
11.2 In the absence of an amicable agreement, the dispute will be brought before the competent courts of Narbonne.
ARTICLE 12 – FORCE MAJEURE
12.1 Les Petits Architectes SAS cannot be held responsible for any delay or failure in the performance of its contractual obligations if this delay or failure is due to a case of force majeure within the meaning of article 1218 of the Civil Code.
ARTICLE 13 – MODIFICATIONS TO THE GTC
13.1 Les Petits Architectes SAS reserves the right to modify these General Terms and Conditions at any time. The new General Terms and Conditions will only apply to sales made after they are posted online on the Site.
13.2 The Customer is invited to regularly consult the T&Cs to be aware of any modifications.
ARTICLE 14 – ENTIRETY OF THE GTC
14.1 These General Terms and Conditions constitute the entire agreement between Les Petits Architectes SAS and the Client. They prevail over any other document or general or specific conditions not expressly accepted by Les Petits Architectes SAS.
ARTICLE 15 – ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
15.1 Any order placed on the Site implies unreserved acceptance by the Customer of these General Terms and Conditions.
